This Privacy Policy sets forth the terms governing the collection, use, disclosure, and protection of personal information by Who's Your Travel Agent Group, also known as Who's Your Travel Agent? ("Wyta," "we," "us," or "our"). By accessing or using any Wyta service, platform, website, or membership program, all users, including travelers and advisors alike, unconditionally agree to this Privacy Policy in its entirety. If you do not agree to this Privacy Policy, you must not access or use any Wyta service, platform, website, or membership program. Please read this document carefully.

Service Delivery

To process memberships, manage advisor accounts, facilitate travel bookings, and communicate with clients and advisors about requests, reservations, and related service activity.

Billing and Payments

To process membership fees, subscription renewals, refunds, chargebacks, and travel-related payments. Billing details are handled through encrypted, PCI-compliant third-party payment processors.

Security and Compliance

To detect, prevent, investigate, and respond to fraud, unauthorized access, misuse, and other harmful activity, and to comply with applicable legal, regulatory, tax, accounting, and recordkeeping obligations.

Communications

To send transactional emails, service notices, policy updates, account-related alerts, and, where you have opted in, marketing communications about travel deals, advisor opportunities, and Wyta news.

Legal Defense and Enforcement

To protect Wyta's rights, property, safety, and operations; investigate suspected violations; enforce our terms, policies, and agreements; establish, exercise, or defend legal claims; and respond to lawful requests and proceedings.

Business Operations and Improvement

To conduct analytics, measure performance, improve our services, develop new products and features, troubleshoot issues, perform internal reporting, and support auditing, forecasting, and strategic planning.

Service Providers & Vendors

We use trusted third-party vendors for payment processing, website hosting, email delivery, customer support tools, and analytics. They are contractually required to protect your data and may not use it for their own purposes.

Travel Suppliers & Partners

To complete bookings, we share relevant information such as name, contact details, and travel dates with airlines, hotels, cruise lines, tour operators, and other travel suppliers as needed to fulfill your reservation.

Legal Obligations

We may disclose your information when required by law, court order, or government regulation, or when needed to protect the safety, rights, or property of Wyta, our members, or the public.

Business Transfers

If Wyta is involved in a merger, acquisition, or asset sale, your personal information may be transferred as part of that transaction. We will notify you by email or a prominent notice on our website if this occurs.

No Sale of Personal Information

Wyta does not sell, rent, or trade personal information to third parties for their own marketing or commercial purposes. This prohibition applies regardless of any future change in applicable law unless we first give you notice and the opportunity to opt out.

Section 6

Membership, Payments & Billing

Recurring Billing

Membership fees are billed on a recurring basis, monthly or annually, depending on the plan selected. Your payment method on file will be automatically charged at the start of each new billing cycle unless you cancel prior to renewal.

Cancellation Policy

Members may cancel at any time by emailing careers@wytagroup.com. Cancellation requests must be received at least 3 days before the next billing cycle begins. Cancellations submitted after a new cycle has been charged will take effect at the end of that billing period.

No Refund Policy

All membership fees are non-refundable under any circumstances, including but not limited to partial use, dissatisfaction, account inactivity, technical issues, or failure to cancel before renewal. This policy applies to all membership tiers and no refunds or credits will be issued for any reason.

Authorization to Charge

By enrolling, you expressly authorize Wyta to charge your payment method on file on a recurring basis until cancellation is confirmed in writing.

Section 6 Continued

How to Cancel Your Membership

Once your cancellation is confirmed, you will receive a written confirmation via email. We recommend retaining this confirmation for your records. Your access to membership benefits will continue through the end of the current paid billing period.

Section 7

Advisor Payment & Commission Practices

Commission Disbursement

Independent travel advisors affiliated with Wyta receive commissions in accordance with their advisor agreement and applicable supplier terms. Commission payments are processed on a schedule disclosed in the advisor agreement and are subject to supplier payment timelines.

Wyta is not responsible for delays caused by third-party suppliers withholding, adjusting, or reversing commission payments due to client cancellations, chargebacks, or supplier policy changes.

Advisor Membership Fees

Travel advisors who pay a membership fee to affiliate with Wyta are subject to the same cancellation and no-refund policy as all members. Membership fees do not guarantee a minimum level of bookings, commissions, or earnings.

Chargebacks & Disputes

Initiating a chargeback or payment dispute without first contacting Wyta in writing constitutes a material breach of this agreement and may result in immediate and permanent termination of membership and advisor status, referral to collections, and legal action to recover amounts owed plus attorneys' fees and costs.

No Earnings Guarantee

Wyta makes no representations or warranties regarding the amount of commissions, bookings, or income an advisor may earn, and past results are not indicative of future performance.

Client Travel Payments & Refunds

Supplier-Controlled Refunds

Refunds for travel products are governed by the policies of the individual travel supplier, such as an airline, cruise line, hotel, or tour operator, not by Wyta. Wyta acts solely as an intermediary and will advocate on your behalf, but refund eligibility, amounts, and timelines are determined solely by the supplier. Wyta bears no financial liability for any supplier refund decision or outcome.

Wyta Service Fees

Any service, planning, consultation, or booking fees charged directly by Wyta or a Wyta-affiliated advisor are non-refundable once any planning, consultation, or booking activity has commenced, regardless of whether the underlying travel booking proceeds or the final outcome of the trip.

Travel Insurance Recommendation

Wyta strongly recommends that all clients purchase comprehensive travel insurance at the time of booking. Travel insurance may protect against cancellation penalties, medical emergencies, trip interruption, and other unforeseen circumstances. Purchase of travel insurance is voluntary but highly encouraged.

Limitation of Wyta Liability for Travel Losses

Wyta is not liable for any loss, injury, damage, delay, cancellation, or other harm arising from travel services provided by third-party suppliers, and clients assume all such risks.

Data Retention

How Long We Keep Your Data

Wyta retains personal information only as long as necessary to provide services, maintain active accounts, comply with legal and regulatory obligations, and resolve disputes or enforce our agreements.

When information is no longer needed, Wyta will securely delete or anonymize it in accordance with its retention schedule. Wyta may retain data beyond the stated periods where required by law, regulation, or ongoing legal proceedings.

Data Security

Encryption

All data transmitted between your browser and our website is protected using industry-standard SSL/TLS encryption. Sensitive data such as payment details is encrypted both in transit and at rest.

Secure Hosting

Our website and member data are hosted on secure, access-controlled servers maintained by reputable infrastructure providers with their own robust security certifications.

Access Controls

Access to personal data within Wyta is restricted to authorized personnel on a need-to-know basis. All team members with data access are subject to confidentiality obligations.

Breach Response

In the event of a data breach that poses a risk to your rights or freedoms, Wyta will notify affected individuals and applicable regulatory authorities as required by law. Wyta's liability for any breach shall be limited to the fullest extent permitted by applicable law.

If you believe any personal information we maintain is inaccurate or incomplete, you may request that we correct or update it so it remains accurate and current.

You may request that we delete your personal information, subject to applicable legal exceptions, including ongoing billing obligations, regulatory retention requirements, dispute resolution, and other lawful bases for retaining data.

Right to Opt Out

You may opt out of marketing communications at any time by using the unsubscribe link in any email or by contacting us directly. Opting out of marketing does not affect transactional or service-related communications.

Right to Restrict Processing

In certain circumstances, you may request that Wyta limit how it processes your personal information, including where you contest the accuracy of the data, object to processing, or need processing to be restricted while a request is reviewed.

All privacy rights are subject to applicable law, identity verification requirements, and Wyta's legitimate legal interests. Wyta may retain personal information as necessary for legal defense, compliance, fraud prevention, security, and other lawful purposes.

How to Submit a CCPA Request

To exercise any of your California privacy rights, please submit a verifiable consumer request to:

Wyta will verify the identity of any person submitting a CCPA request before fulfilling it. We will respond to verified requests within 45 days as required by law. Wyta does not discriminate against users who exercise their CCPA rights.

Wyta does not knowingly sell personal information and has not done so in the preceding 12 months.

Section 12

Children's Privacy

Age Restriction

Our services are intended for adults aged 18 and older. Wyta does not knowingly collect, solicit, or use personal information from individuals under the age of 18.

What We Do If We Discover a Minor's Data

If we become aware that we have inadvertently collected personal information from a person under the age of 18 without verifiable parental consent, we will take prompt steps to delete that information from our records. Parents or guardians who believe their child has provided us with personal information are encouraged to contact us immediately at info@wytagroup.com so we can investigate and take appropriate action.

Any user who misrepresents their age to access Wyta services does so at their own risk, and Wyta bears no liability for such misrepresentation. Wyta reserves the right to terminate any account where a user is found to be under 18.

Wyta complies with the Children's Online Privacy Protection Act (COPPA) to the extent applicable to our services.

Section 13

Third-Party Links & External Platforms

Independent Privacy Policies

Each third-party website you visit has its own privacy policy and data practices. We encourage you to review the privacy policy of any external site before submitting personal information. Wyta expressly disclaims all liability for the content, privacy practices, data security, or actions of any third-party website or platform.

Supplier & Booking Platform Integrations

When you book travel through Wyta or an affiliated advisor, your information may be transmitted to supplier booking systems, global distribution systems (GDS), or third-party reservation platforms. Your data in those systems is subject to the respective supplier's privacy terms.

Social Media Platforms

If you interact with Wyta through social media platforms such as Instagram, Facebook, or LinkedIn, the information you share through those platforms is governed by the platform's own privacy policy. Wyta does not control how those platforms collect or use your data.

No Endorsement

The inclusion of any third-party link does not constitute an endorsement, recommendation, or approval by Wyta of that third party or its products, services, or practices.

Section 14

Marketing Communications & Opt-Out

Types of Communications We Send

Wyta may send two types of email communications:

  • Transactional: Booking confirmations, membership receipts, cancellation confirmations, account notices, and policy updates. These are sent regardless of marketing preferences.
  • Marketing: Travel promotions, advisor opportunities, Wyta news, and special offers. These are sent only if you have opted in or if permitted by law.

How to Opt Out

You may opt out of marketing communications at any time using either of the following methods:

  • Click the "Unsubscribe" link at the bottom of any marketing email

Please allow up to 10 business days for your request to take effect. Until it is processed, you may continue to receive marketing emails. Even after opting out, you will still receive transactional and legally required communications related to your account, memberships, or bookings. Wyta is not liable for any marketing communications sent before your opt-out request is processed.

Section 15

International Users

Consent to Transfer

By using Wyta's services from any location, you irrevocably consent to the transfer, storage, and processing of your personal information in the United States under U.S. law. Wyta makes no representation that its services comply with the laws of any jurisdiction outside the United States.

No Intentional International Marketing

Wyta's services are primarily directed toward consumers and travel advisors based in the United States. We do not intentionally market to residents of the European Union, United Kingdom, or other jurisdictions with specialized data protection regimes such as GDPR. If you are a resident of such a jurisdiction, we encourage you to consult local legal guidance before using our services.

Assumption of Risk for International Use

If you access Wyta from outside the United States, you do so at your own risk and are solely responsible for complying with all applicable local laws.

Section 16

Dispute Resolution & Governing Law

Governing Law

This Privacy Policy and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of the United States and the state of Oklahoma, without regard to conflict of law principles. Wyta is headquartered in Tulsa, Oklahoma.

Jurisdiction

Any legal action or proceeding relating to your access to, or use of, our website or services shall be brought exclusively in the federal or state courts of competent jurisdiction in Tulsa, Oklahoma. You consent to personal jurisdiction in those courts.

Informal Resolution First

Before initiating any formal legal action, we ask that you contact us at info@wytagroup.com to describe your concern in detail. Wyta is committed to resolving disputes fairly and promptly. Many concerns can be addressed quickly through direct communication without the need for formal proceedings.

Mandatory Arbitration

Except where prohibited by law, all disputes arising out of or relating to this Privacy Policy, Wyta's services, or your relationship with Wyta shall be resolved by binding arbitration on an individual basis. You and Wyta waive any right to participate in a class action lawsuit or class-wide arbitration against Wyta.

Limitation of Liability

To the fullest extent permitted by applicable law, Wyta shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Wyta's total liability in connection with any privacy-related claim shall not exceed the greater of $100 or the amount paid by you to Wyta in the 3 months preceding the event giving rise to the claim.

Changes to This Privacy Policy

Wyta reserves the right to update or modify this Privacy Policy at any time to reflect changes in our business practices, legal requirements, or the services we offer. When we make material changes, we will notify you in the following ways:

Your continued use of Wyta's services after the effective date of a revised policy constitutes your acceptance of the updated terms.

Your continued use of Wyta's services after the effective date of any revised policy constitutes irrevocable acceptance of the updated terms. If you disagree with any changes to this policy, your sole remedy is to discontinue use of our services and cancel your membership in accordance with the cancellation procedure described in Section 6.

Section 18

Indemnification

By using Wyta's services and accepting this Privacy Policy, you agree to indemnify, defend, and hold harmless Wyta and its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our services. This indemnification obligation survives the termination of your membership or relationship with Wyta.

Any use or misuse of the Wyta platform, website, or services by you or anyone accessing our services using your credentials.

Violation of This Policy

Any breach of this Privacy Policy, our Terms of Service, or any applicable law or regulation by you in connection with your use of Wyta's services.

Inaccurate Information

Any false, misleading, or inaccurate information you provide to Wyta, including information used for account registration, booking requests, or advisor applications.

Scope of Indemnification

This obligation also includes any claims arising from your violation of any third-party rights, including intellectual property, privacy, or contractual rights. Wyta reserves the right to assume exclusive control of any matter subject to indemnification at your expense.

Section 19

Entire Agreement

Policy Integration

This Privacy Policy, together with Wyta's Terms of Service, Membership Agreement, and any applicable advisor agreements, constitutes the entire agreement between you and Wyta with respect to your privacy and the handling of your personal information.

In the event of any conflict between this Privacy Policy and any other document, this Privacy Policy governs with respect to privacy matters unless a written agreement signed by an authorized Wyta representative expressly states otherwise.

Severability

If any provision of this Privacy Policy is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and if necessary, deemed modified to the minimum extent required to make it valid and enforceable. All remaining provisions shall remain in full force and effect.

No Waiver

Wyta's failure or delay in enforcing any right or provision of this Privacy Policy shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized Wyta representative to be legally effective.

Force Majeure

Wyta shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, cyberattacks, or other force majeure events.

Wyta is committed to making this Privacy Policy accessible and understandable to all users, including those who may require accommodation. If you have difficulty accessing, reading, or understanding any portion of this Privacy Policy due to a disability or other limitation, please contact us and we will work to provide the information in an alternative format.

This policy is written in plain American English to the extent possible while maintaining legal accuracy. We have intentionally avoided unnecessary legal jargon to ensure that consumers, independent travel advisors, and all other users can understand their rights and our practices clearly.
